Naghain ng panukala si House Deputy Minority Leader Leila M. de Lima para pahintulutan ang Office of the Ombudsman na magkaroon ng kapangyarihan na magbusisi at masilip ang bank accounts at records para sa imbestigasyon o pagsisiyasat nang hindi kinakailangan ng kautusan ng korte.
Sa ilalim ng House Bill No. 5701, isinusulong ni De Lima na maamyendahan ang Section 15 (8) ng Republic Act (RA) No. 6770 o ang “The Ombudsman Act of 1989” at Section 2 ng RA 1405, o ang “Law on Secrecy of Bank Deposits.”
“The Office of the Ombudsman – the primary authority in the fight against corruption – has to go through the court if it wants to access and examine bank accounts and records,” saad ni De Lima.
Matatandaang sa kaso ng Marquez v. Desierto (2001), batay sa Section 15 (8) ng “The Ombudsman Act of 1989”, idineklara ng Supreme Court na hindi maaaring masilip at mabusisi ng Office of the Ombudsman ang bank account at records ng iniimbestigahan at sinisiyasat nito.
“To clarify this matter and to supplant Marquez, there is a need to amend Section 15 (8) of RA 6770 and Section 2 of RA 1405”, to expressly grant the Office of the Ombudsman the authority to examine and access bank accounts and records, without the necessity of going to court,” ani mambabatas.
“This will not only strengthen the subpoena power of the Office of the Ombudsman, aiding it in its investigation of allegations of anomalies and irregularities in the government. This will also help in deterring corrupt officials and their accomplices in taking advantage of legal loopholes in our banking system,” dagdag niya.
Sa oras na maisabatas, magkakaroon ng kapangyarihan ang Ombudsman na mangasiwa ng panunumpa, mag-isyu ng subpoena duces tecum, at kumuha ng testigo kabilang ang kakayahan na magbusisi at magkaroon ng access sa bank accounts at records na kinakailangan sa imbestigasyon kahit hindi na dumaan sa korte.
“Ayon sa mga nabunyag sa mga imbestigasyon, trilyong piso mula sa kaban ng bayan ang hindi nagamit para sa mga proyektong dapat sana ay mapapakinabangan at makakatulong sa mga Pilipino. Instead, the money flowed into the hands of certain corrupt politicians, middlemen, government personnel, and private contractors,” pagbibigay-diin ni Mamamayang Liberal Party-list Representative.
Giit pa niya, higit na dapat palakasin ngayon ang kapangyarihan ng Ombudsman bilang Tanodbayan para sa pag-iimbestiga sa mga anomalyang tulad sa flood control projects lalo na at tila nagagamit na butas ang batas para hindi mabisto at mapagtakpan ang kanilang mga iregularidad.
